1. Terminology
1.1 In these Terms & Conditions the following words shall have the following meanings:
“The Park” means Lightwater Valley Family Adventure Park and its grounds.
“Company” means Lightwater Valley Attractions Ltd.
“Contract” means these Terms & Conditions
“Management” means the Management of Lightwater Valley Attractions Ltd.
“Park Staff” means the staff, employees and representatives of Lightwater Valley Attractions Ltd.
“Guests(s)” means the company, firm or individuals present within The Park. “Ticket” means the entry ticket and respective cost of that ticket into The Park.
2. General
2.1 The Management will attempt to ensure that as many rides and attractions as possible are open for use by guests, however The Management reserves the right to alter or change the programmes of rides and attractions if at any time it is deemed necessary to do so.
2.2 All persons visiting The Park are admitted subject and agreeing to the Contract.
2.3 The Management reserves the right to not issue any refunds.
2.4 The Management and Park Staff reserve the right to refuse admission and / or to remove from The Park, in its absolute discretion and without giving any reasons, any person failing to comply with the Contract or whose presence is, in its absolute discretion, a source of danger or annoyance and shall have no obligation to give any reason therefore.
2.5 Height and other size restrictions apply on rides. Details are provided on our website, at The Park entry gate and at each ride entrance.
2.6 Guests under 16 years of age must be accompanied by an adult and will not be allowed, unaccompanied into The Park for safety reasons. Proof of age will be requested at our admissions booths and entry may be refused.
2.7 Parking or setting down within The Park is prohibited, other than at the official car parks.
2.8 Entry into, and the right to remain within, The Park is subject to the requirement to submit to search or searches of guests, their baggage or the vehicles in which they travel.
2.9 Management accepts no responsibility for vehicles or their contents, which are left entirely at owner’s risk.
2.10 No dogs are allowed anywhere on the Park, except for assistance dogs. Dogs should not be left in vehicles in the car park unattended.
2.11 Items, including mobile phones and cash left in lockers or at rides are left at owner’s risk.
2.12 Lost children and lost item enquiries should be made at our Visitor Information office.
2.13 Guests are not permitted to bring their own alcohol into the park.
2.14 Any behaviour such as drunkenness, violent or abusive conduct, singing or shouting which may constitute an annoyance to other Guests or Park Staff is prohibited.
2.15 Anyone displaying lewd, offensive, or threatening behaviour (either to Guests or Park Staff) will be removed from site without a refund.
2.16 The Guest shall not (and shall ensure that all guests/delegates and third parties employed do not) use the name, logo or any details of The Park or the Company for any matter.
2.17 The Guest shall not (and shall ensure that all guests/delegates and third parties do not) permit any goods, services or any other matter capable of being sold (including, but not limited to, tickets) to be sold within The Park without the prior written approval of the Company and any public authority (where necessary).
2.18 Any person who is not party to the Contract shall have no rights under the Contracts (Right of Third Parties) Act 1999 to enforce any terms of this Contract. The clause does not affect any right or remedy of any person which exists or is available otherwise than the pursuant to that Act.
2.19 No variation or alteration of any of the Contract shall be effective unless it is in writing and signed by or on behalf of each party
2.20 This Contract shall be governed by English Law and the parties to this Contract submit to the jurisdiction of the English courts.
3. Tickets
3.1 All Guests entering must have a valid entrance ticket/ confirmation.
3.2 Tickets are not transferable and accordingly may not be sold or passed on to any third party.
3.3 Tickets are sold, both online and on the day, on the understanding that no money in respect of unused tickets will be reimbursed.
3.4 Lost or stolen tickets will not be replaced.
4. Online Ticket Booking
4.1 Pre-booked online tickets offer a park entry rate of £26.50 for adults or children or £30.00 on the day. Booking online does not entitle "fast track" entry and as such you may need to queue at our admissions windows to gain entry.
4.2 Guests can also book tickets online at reduced prices for over 65's, disabled tickets and Military/ NHS/ Emergency service personnel.
4.3 Tickets purchased online and on the day are non-refundable and non-transferable.
4.4 All online transactions incur a non-refundable £2.95 admin fee per booking.
4.5 When redeeming pre-paid internet tickets on arrival, we require a copy of your email booking confirmation that includes the booking reference number and barcode (printed or on a mobile device).
4.6 The management are not obliged to refund monies or exchange tickets.
4.7 Attractions and rides may be unavailable at any time for technical or operational reasons.
4.8 Concessions for carers: We only accept the Nimbus Disability Access Card as proof that a visitor requires an essential carer to assist you with your visit. Click here to apply for a Nimbus Access Card. Please allow 7 days for your application to be processed before visiting. Visitors without an Access Card or Digital ID will be charged the standard admission price on arrival.
4.9 Tickets purchased online entitle the purchaser to the same rights as pay-on-the-day tickets.
4.10 Guests wanting to change the date of a pre-booked visit can do so by contacting the Visitor Experience team. Date changes must be done at least 24 hours in advance of the original date of visit. An administration fee of £1.50pp will be charged for every date change.
5. Fire, Health and Safety
5.1 The climbing of fences, walls, stands or any other buildings is forbidden.
5.2 The misuse of rides, interference with equipment or devices which are there in the interests of safety is a criminal offence, offenders will be asked to leave the park without a refund and may be subject to prosecution.
5.3 Ignoring safety warnings given either verbally or by signage may result in being asked to leave the site without a refund.
5.4 The possession or use of illicit drugs is strictly forbidden.
5.5 The possession of any weapon or other item to cause damage or injury to persons or property is strictly prohibited and may result in criminal action being taken.
5.6 Any person failing to comply with instructions from a member of Management may be ejected from The Park with no refund.
5.7 The Guest shall pay for the cost of repairing any damage caused to the property, contents or grounds of The Park and the Company and its Guests
5.8 The Company reserves the right to evacuate The Park in the event of a Fire Alarm, or other emergency irrespective of whether it is a genuine emergency or not, in order to protect all Guests, Management and Park Staff and in this event, does not accept any liability for any delay and is not liable to refund part or all of the Ticket.
6. Smoking Policy
6.1 Smoking (including the use of e-cigarettes) is strictly prohibited within all areas of the theme park (including in queues at admissions and at rides) with the exception of designated smoking areas.
6.2 Management and Park Staff reserve the right to refuse admission or to evict Guests from these areas should they violate clause 6.
7. Liability
7.1 The Company shall in no circumstances be liable for any loss, damage, cost or expense or any consequential or indirect loss or damage of any kind.
7.2 The Company does not accept responsibility for parental supervision or guardianship for any individuals under the age of 14 years.
8. Force Majeure
8.1 In this clause 8, “Force Majeure” means any circumstances beyond the control of The Company including, but not limited to, acts of God, adverse weather conditions to war, civil disturbance, order of a Government Ministry or department or public authority, fire, flood, natural catastrophe, royal demise, labour dispute, lock-out, withdrawal of labour or breakdown or interruption of services or transport (public or otherwise) or death or illness of a key person, lack of power and delays by suppliers or materials shortages.
8.2 If the Company is prevented from or hindered from operating or partially operating by a Force Majeure the Company may, at its sole option, and without being liable for any loss or damage suffered by the Guest or guests/delegates of or any thirds party employed by the Guest suspend operations for the period of the event plus such time as may be required to resume normality. Such an event shall not entitle visitors to take any steps against the company for breach or to terminate the agreement or otherwise.
9. Promotional Codes and Voucher Codes
9.1 Lightwater Valley Attractions Ltd. reserves the right to cancel or amend promotional/voucher codes and their terms and conditions at any time without prior notice. Your statutory rights are not affected.
10. Photography
10.1 From time to time Lightwater Valley Attractions Ltd or other authorised parties carry out photography and/or video recording within the theme park, which may feature visitors. Entry to the Lightwater Valley complex is deemed acceptance of these regulations and you therefore agree that Lightwater Valley Attractions Ltd or any authorised party may use such images in perpetuity in any promotional, advertising or publicity material in any format whatsoever. You further agree that copyright in these materials rests with Lightwater Valley Attractions Ltd or such authorised party (as the case may be).
